On May 21, 2013, the Miami-Dade Board of County Commissioners authorized the execution of a Consent Decree between Miami-Dade County, the United States of America, the State of Florida and the Florida Department of Environmental Protection, for improvements to the County’s wastewater collection and treatment system.

On June 6, 2013, the Department of Justice lodged the proposed Consent Decree with the United States District Court for the Southern District of Florida in the lawsuit entitled United States, State of Florida and State of Florida Department of Environmental Protection v. Miami-Dade County.

On June 12, 2013, the Notice of Lodging was published in the Federal Register. The publication opened a 30-day public comment period on the Consent Decree. On July 15, 2013, the comment period was extended to 60 days, by Notice in the Federal Register. All comments were to be submitted no later than August 11, 2013.

The Effective Date for the Consent Decree is December 6, 2013, six months after the Date of Lodging. On April 9, 2014, the Court issued orders: Granting Motion to Enter Consent Decree, Modifying Section X of the Consent Decree and Requiring Status Reports.

Miami-Dade County entered into a federally-mandated Consent Decree with the U.S. Environmental Protection Agency and the Florida Department of Environmental Protection and is committing to making improvements to the wastewater collection and treatment system totaling $1.6 billion over the next 15 years.

Pursuant to the Consent Decree, a copy of each Deliverable shall be made available in a Public Document Repository (PDR) and at the Miami-Dade Water and Sewer Department's main office. Additionally, in accordance with the Consent Decree, any person or entity may elect to register to receive an electronic notice that a new or revised Deliverable is available in the PDR.
