What is Code Relief? Code Relief allows structures built without proper permits, or built with permits that are lacking mandatory inspections, into compliance with the Building Code. Construction projects must have commenced prior to March 1, 2002 to qualify for reissuance.
What are Owners' Responsibilities? The current owner of the property is ultimately responsible for bringing the property into compliance.
If permits were issued to licensed contractors, but mandatory inspections were not obtained, you should contact the contractors and request that they reissue the permit under the provisions of Ordinance 02-44. If the previous contractors are unavailable, you must apply for a permit reissue with a new contractor or apply on your own as an Owner-Builder.
To find out if there are any open permits that have not been finalized, use the online search and select the options for “Open Master Permit (Address)” or “Open Permits by Folio (Folio Number)”. Be prepared to provide the property address/folio number.
To reissue your permit so you may call for required inspections, you will have to complete a new application with your original set of plans and obtain approvals from departments that originally reviewed the permit. To obtain your original set of plans you must contact the Microfilm Unit.
The reissue application and plans will be processed as per the applicable building code requirements at the time of permit issuance. However, the following life-safety requirements of the current building code must always be complied with:
Means of egress or escape
Requirement of shutters
Hard-wired smoke detectors
Ground fault interrupter (GFI)
Full size pressure and temperature relief valved lines must be installed on all water heaters
Handicapped access requirements
All gas piping systems must be bonded to ground
Handrails must be inspected and replaced, if necessary, in full compliance with Zoning requirements
Any requirements of federal/state laws or other preemptive laws, codes, or standards.
Additionally, you will need to obtain an As-Built Certificate from State of Florida duly licensed engineers or architects, attesting to the best of their knowledge, belief, and professional judgment, that after their inspection, the structure is:
Structurally sound
Satisfies the requirements of the code in effect at the time the work was commenced, indicating the date the work commenced and the requirements of the code in effect on that date
Complies with all requirements of the current code identified above
Complies with the permit application and plans approved by the department.
Additionally, the As-Built Certificate must contain a narrative description of the methodology utilized to make the determination set forth in the As-Built Certificate. If the work was performed at any time during which this code accepted certification by masters in their respective trades as a condition of issuance of a Certificate of Completion, then a master will be authorized to issue the As-Built Certificate in accordance with work involving their trade that otherwise complies with all requirements of this subsection.
To obtain a permit for work performed without proper permits, you will be required to complete a new application with as-built set of plans and obtain approvals from the trade disciplines. At minimum, plans should include the following:
Site plan
Floor plan
Sufficient detail, where applicable, of structural, electrical, mechanical, plumbing and roofing components
Additionally, you will need to submit evidence of when the construction was performed so the appropriate code requirements can be enforced. This documentation could include aerial photographs, tax records and/or surveys.
The plans will be processed as per the code requirements at the time of construction. However, the following life-safety requirements of the current code, must be always complied with:

The fee for the reissuance of an existing permit and permit for work performed without the proper permits can be found in the Fee Schedule.
In addition to those fees, applicable Impact Fees will be assessed.
Depending on the scope of work, plans may require review by Miami-Dade Fire Rescue, Water and Sewer, and/or the State of Florida Department of Health (HRS). Check with the applicable agencies.
Once your plans and documents have been approved, applicants may pay their balance by entering their process number in the Pay Fees Now section. Once payment is accepted, applicants may print the Permit Card.
Once the permit is issued, inspections must be requested for all applicable trades.
Inspectors will conduct an inspection to determine the following:
Plans submitted reflect the current state of the structure; and
The construction complies with the code in effect at the time and complies with current code requirements listed on Section 11(g)(2)(c) of Chapter 8 of the Miami-Dade County Code
The As-Built Certificate represents accurately the condition of the structure.
